Independent Commercial Arbitration & Mediation Independent Commercial Arbitration & Mediation

Dear Colleagues and Friends, I am no longer accepting new appointments for arbitrations or mediations.  I look forward to completing my existing appointments within the coming year and making more time for other interests and activities while I remain in good health and reasonable vigour!

I have done one final update to my website as a record and example of the incredibly satisfying opportunities that are available to those who pursue a career in commercial arbitration in Canada, opportunities both to learn about the world of business and to contribute to the business-like resolution of its inevitable disputes.

Some of the thoughts and tools I have published may be of continuing use as a starting point for those who are new to the field. You may want to look at my “Arbitration Clause Builder”, draft Terms of Appointment or Sample Procedural Order in my Resources section. I am gratified that the procedural order I developed based on my article on “Evidence First Arbitration” has served as a model for the Sample Procedural Order under the new ADRIC National Rules of Arbitration.  There is also a PowerPoint presentation on ad hoc (non-institutional) arbitration, which is (and which I hope will remain) the dominant form of commercial arbitration in Canada.

The challenge of improving commercial arbitration so that it better serves businesses will continue.  The Publications page on this website contains links to some of my past contributions.  I hope and expect to have more thoughts to share in the future.
